Asphalt Plant Regulation

The Ministry of Environment intends to review and potentially revise the Asphalt Plant Regulation (APR) of the Environmental Management Act (EMA). The review process follows up on the Air Action Plan commitment for encouraging companies to use the cleanest available technologies. The Air Action Plan can be accessed here.

The asphalt plant industry is currently regulated by the Asphalt Plant Regulation which came into force June 27, 1997. Prior to that, these types of operations were authorized to discharge to the environment by permit. The regulation sets out, among other requirements, emission limits (both concentration and production based), monitoring requirements, plant maintenance, location, operating restrictions, and public notification, for the hot-in-place (HIP), hot mix asphalt (HMA), and cutback asphalt industry.
