Minor Amendments to the Integrated Pest Management Regulation (October 2006)

Industry Sector Guidance to the Minor Amendments

Minor amendments to the Integrated Pest Management regulation came into force on October 1, 2006. The purpose of these amendments was mainly to clarify policy intent.

The following table indicates the industry sector for which each amendment is the most relevant.

User licensees may sell surplus pesticide to other user licensees, confirmation holders, or certificate holders who are qualified to use the pesticide, without seeking a vendor's licence, if the licensee notifies the administrator of the sale.

The term "licence year" is amended so that it means the period from the date a licence is issued until March 31 in the next year.

All sectors Those who store pesticides will be required to notify the fire department that is responsible for fire protection at the location where the pesticides are stored. Notification is not required if the location is not protected against fire.

A licensee is required to keep a copy of their applicator certificate(s) at or near the treatment area during pesticide use.

The requirement that persons restrict the use of pesticide to daylight hours is removed when the pesticide use and person applying the pesticide is artificially illuminated so that they are clearly visible from a distance of 30 metres.

Agriculture The definition of "agriculture" is further refined through reference to the Standards for the Classification of Land as Farm Regulation, which provides a detailed list of agricultural activities.

Agriculture Permit requirements are also amended to exclude most agricultural activities carried out on public land, except for agricultural activities carried out under a permit or licence issued under the Range Act.

Vendors The class of "domestic pesticides" is amended to include pesticides contained in fertilizers registered under the federal Fertilizers Act. These products are intended for homeowner use and should be regulated in the same manner as other domestic pesticide products.
