General Discharge Instructions

Applying for a Permit

An application fee must be paid before an application will be processed. In accordance with Section 2 of the Environmental Management Act Permit Fees Regulation, the application fee is assessed based on proposed discharge rates and characteristics of contaminants. The applicant should consult the Environmental Protection office to determine the correct application fee. Cheques should be made payable to the Minister of Finance.

In addition, posting and publishing of the application will be required in accordance with the Public Notification Regulation. The application shall be posted in a conspicuous location at or near the proposed site of discharge, emission or storage site, within 15 days from the date of signing the application. The date of posting shall be indicated on the application form (bottom of front page).

The applicant will be responsible for expenses incurred in publishing of the application in the local newspaper and the BC Gazette. The ministry will arrange for publishing in the BC Gazette. Unless the Environmental Protection office advises that publishing will not be required, the Gazette publishing fee of $72.50 (payable to the Minister of Finance) should be included with the application package. Publishing of the application in the local newspaper is the responsibility of the applicant. Instructions for completing this requirement will be provided by this office once the application is received.

If the applicant elects to appoint an agent to deal with the ministry on their behalf, the Agent Authorization section of the application (on the back side) shall also be completed.

The fully completed application must be received by the Environmental Protection office within 15 days from the date of signing. All information requested on the application form must be provided or it may not be accepted.

In accordance with Section 2 of the Waste Management Permit Fees Regulation, the application fee is assessed based on discharge rates and characteristics of contaminants. The current base fee for an amendment application is $100.00. If the amendment pertains to an increase in discharge contaminant, an additional variable fee may apply. The applicant should consult the Environmental Protection office to determine the correct application fee. Cheques should be made payable to the Minister of Finance.

Posting and publishing of the application may be required in accordance with the Public Notification Regulation. The application shall be posted in a conspicuous location at or near the proposed site of discharge, emission or storage site, within 15 days from the date of signing the application. The date of posting shall be indicated on the application form (bottom of front page).

Guide to Completing an Application

The application form must be typed. Hand written, or incomplete forms, will be returned to the applicant.

The name of a company must be the Registered Company name as registered with the Ministry of Finance. If this name is not the usually used name of the business, then the usual name may be given as well. A partnership must give the names of all of the partners. Private individuals must give their full legal name.

The address should be the mailing address of the operation that will be discharging.

The type of operation is, for example, a sawmill or an oil refinery etc.

The location should be a geographic description, which describes the location for public information.

The legal description should be that of all of the property from which a discharge is emitted, or received, in the case of a landfill.

Quantities of discharges must be given in metric units, using the same units as set out in the criteria in the appropriate Provincial Pollution Control Objectives.

Locations of discharge should be geographic descriptions.

The ministry suggests that a DRAFT application be submitted to ensure all required information is submitted and correct.

Instructions for Publishing an Application

The face side only is to be published.

The appropriate location is in the Legal Notices Section of the classified advertisements.

The advertisement shall be at least 10 centimetres in width and at least 100 square centimetres in area.

The advertisement shall be entitled "ENVIRONMENTAL PROTECTION NOTICE" in a minimum type size of 12 points, and

Shall have the text of the application in a minimum type size of 8 points.

The applicant must, within 30 days after the date of publication, provide to the manager a copy of the full page tear sheet as proof that the application was published.

Failure to provide the manager with a copy of the tear sheet may delay the processing of the application.
