Hazardous Waste Definition

Hazardous Waste means

  1. dangerous goods that are no longer used for their original purpose, including those that are:
    1. recycled, treated or disposed
    2. intended for recycle, treatment or disposal
    3. in storage or transit before recycle, treatment or disposal
  2. PCB waste
  3. wastes containing dioxin
  4. waste oil
  5. waste asbestos
  6. waste pest control product containers and wastes containing pest control products, including wastes produced in the production of treated wood products using pest control products
  7. leachable toxic waste
  8. waste containing tetrachloroethylene
  9. waste containing polycyclic aromatic hydrocarbons

Does not include

  1. household refuse that is collected from residential premises
  2. domestic sewage
  3. dangerous goods that are defective, surplus or otherwise not usable for their intended purpose and that are in the process of being returned directly to a manufacturer or supplier
  4. asphalts and tars used in the manufacture of asphaltic concrete and roofing materials
  5. radioactive dangerous goods included solely in class 7 of the Federal Regulations
  6. dangerous goods listed in List II of Schedule II of the Federal Regulations, and that have the numeral "37" in column IV of that list
  7. waste wood products treated with wood preservative or wood protection products registered under the Pest Control Products Act (Canada), or household hazardous waste that
    1. is removed from a return collection facility in accordance with an authorization from the owner of the return collection facility
    2. is to be reused for its originally intended purpose
