Schedule "B"

Compliance and Enforcement Protocol

The purpose of this schedule to the agreement is to outline the protocol for a compliance and enforcement partnership between the Regional District of Comox-Strathcona (RDCS), the Ministry of Environment, Lands and Parks (MELP) and the Fisheries and Oceans Canada (F&OC).

Signatories to this agreement are guided by the following principles:

  • recognizing that each agency has a responsibility for compliance and enforcement activities contained within their respective legislative mandates. For the purpose of this MOU the following mandates are applicable.

RDCS - Regional District by-laws, Building and Land Use Regulations

F&OC - Federal Fisheries Act and Regulations

MELP - Wildlife, Waste, Pesticide, Water and Firearms Acts and Regulations

  • that the working relationship between the parties will be marked by

    • mutual trust and respect

    • open, complete and timely sharing of information

    • meeting commitments, and

    • solving problems at the most appropriate level.

  • that a continuum of compliance and enforcement activities ranging from providing information, at one end of the spectrum, through to legal proceedings are available to promote and achieve compliance. Compliance is a level of conformity with the law that can be achieved through a variety of activities including communication, education, consultation, inspection, monitoring, orders, injunctions and legal actions.

Each agency agrees, for the term of this agreement, to:

1. provide a contact list of compliance and enforcement staff with responsibility in the RDCS boundaries;

2. forward issues in a timely manner to the appropriate agency for resolution;

3. respond in a timely and effective manner, within the limits of their legislative mandate, to reports of environmental damage taking place within the RDCS;

4. provide regular updates to the reporting agency on the results of compliance issues forwarded for resolution;

5. raise issues concerning compliance trends for discussion at the quarterly review meetings for the purpose of developing an effective compliance and enforcement strategy;

6. promote a teamwork approach in those compliance and enforcement activities that have cross jurisdictional application and utilize the most effective options to achieve compliance; and

7. work to support sustained environmental values in the RDCS.
