Timing Windows

Section 42 (1) To protect habitat, a person making a change in and about a stream under this regulation, other than under section 44(1)(o) to (s) or (2), must make that change in accordance with terms and conditions specified by the habitat officer with respect to (Note: under the Water Act a “stream" includes a natural watercourse or source of water supply, whether usually containing water or not, ground water, and a lake, river, creek, spring, ravine, swamp and gulch);

Region Specific Information

East Kootenay Integrated Lakes Management Partnership (EKILMP): Shoreline Management Guidelines have been developed for a number of lakes in the East Kootenay. They are intended to be used as an initial step when reviewing, planning for, or prescribing alterations along the shoreline. The Guidelines identify shoreline color zones, activity risk analysis and the process of proceeding with applications for works along the shoreline.

Okanagan Large Lakes Foreshore Protocol: The protocol elaborates on the strategic direction provided of the Okanagan Shuswap Land and Resource Management Plan and applies to Christina Lake in the Boundary. This document identifies the risks to fish and species at risk and their habitats based on specific development activity and outlines the instream application requirements.

Federal Guidelines

Fisheries and Oceans Canada Regional Operating Statements: Fisheries and Oceans Canada has developed a series of 17 Operational Statements to streamline the undertaking of low risk activities. The Operational Statements outline conditions and measures for avoiding harmful alteration, disruption and destruction (HADD) of fish habitat, and applying them will ensure your project complies with subsection 35(1) of the Fisheries Act.
